The Slovak Supreme Court will have to deal again with a decision by former justice minister Štefan Harabin – who now serves as the Supreme Court’s president – when he recalled judge Robert Urban from the post of Žilina Regional Court chairman almost five years ago.
The Constitutional Court overruled the verdict of the Supreme Court and ordered it to re-hear Urban’s case, the SITA newswire wrote. The Constitutional Court decided that Urban’s rights to court protection and a fair court proceeding were breached.
The Constitutional Court also awarded compensation of €2,000 to Urban, who will also receive repayment of court fees of €775.34. This is the last case in a series of lawsuits filed by seven court chairmen who were removed from their positions by Harabin when he was justice minister.
