Pair in controversial video accused of rioting

THE POLICE charged a young woman and her partner, who appeared in a video recently published by the Topky.sk website showing them having a sex on the street, of rioting. The media outlets reported earlier in the week that the video seemed to be a rape, and widely criticised the website for its publishing.
The incident happened on April 23 in Krompachy, Košice Region, shortly after 15:00. Someone reported to the police that the man is allegedly trying to rape a young woman directly in front of small children. The local police officers came to the scene shortly after the incident. The police have immediately detained the man and gave him to the state police. The state police than investigated the case as suspicion of rape, the public-service broadcaster Radio and Television of Slovakia (RTVS) reported on June 26.
The police then heard the man and the woman, as well as the witness who reported the case to the police. The woman did not confirm the rape.
“Both say that it was voluntary, without forced violence,” said Police Corps President Tibor Gašpar, as quoted by RTVS. “Since it was in the public and on place accessible by the public, we classify the crime as rioting.”
Neither local, nor state police officers saw the video, published on the internet, when investigating the incident. The recording shows the woman shouting “No”, and two crying children that stand nearby, according to RTVS.
Lucia Kurilovská, a lecturer at the Department of Criminal Law, Criminology and Criminalistics at the Faculty of Law of Comenius University, told RTVS that the woman may have had fear when giving her testimony. The video on the internet, however, is new evidence.
Neither police nor the prosecutor’s office have excluded the possibility that the crime can still be reclassified as rape.
“We will now check the steps of police and will decide whether the prosecution will continue and for which crime,” said Milan Filičko, spokesman for the Košice Regional Prosecutor’s Office, as quoted by RTVS.
