Trnka keeps prosecutor’s mandate for now, case to be re-examined

FORMER general prosecutor (GP) Dobroslav Trnka will not be relieved of his mandate as prosecutor and his case is to be re-examined by the Disciplinary Committee of the General Prosecutor Office, the Bratislava Regional Court decided December 18, the TASR newswire reported.

Trnka had lost his job as a prosecutor – the sternest punishment possible by the Disciplinary Committee – over the Glance House case. It revolved around the shady transfer of the Glance House apartment block in Bernolákovo in Bratislava region that took place in 2009 under the auspices of then GP Trnka and involved his long-time friend, controversial businessman Marian Kočner. Trnka filed the appeal with the Regional Court on December 31, 2013 objecting that the Committee was formed in an unlawful manner, according to TASR.

The Court overturned the decision of the Disciplinary Committee from November 2013 and ordered Trnka’s case to be re-examined after partially accepting his objection. This verdict is final and cannot be appealed.

“Unbiased proceedings must be guaranteed also by the process of the formation of the Disciplinary Committee, where no intervention from superiors is acceptable,” said the Bratislava Regional Court’s judge, as quoted by TASR. “Regardless of the reason, manipulation of any kind raises doubts about the intent of such an intervention.”

The General Prosecutor Office maintains that the formation of the Committee was lawful. No action has been taken whether by incumbent GP Jaromír Čižnár or anyone else that might challenge the legitimacy of the Disciplinary Committee, according to spokeswoman Andrea Predajňová.

“We perceive the today’s verdict of the Bratislava Regional Court in the aforementioned matter to be scandalous,” Predajňová said, as quoted by TASR.
