Harabin to go before Judicial Council

REACTING to recent cases when the Supreme Court criminal panel chaired by Štefan Harabin released sentenced criminals, Supreme Court President Daniela Švecová has summoned the Judicial Council to a meeting scheduled for next week.

The Judicial Council shall decide on the fate of Harabin and his panel members, while Švecová proposes to mix individual members of Harabin’s panels that have already issued several controversial decisions in other cases. The possibility that Harabin will work in one panel with his harshest critics Milan Karabin and Juraj Kliment was mentioned as being the most radically possible solution, the Sme daily wrote on August 13.

Transparency International says, based upon the current development, that when Harabin lost the post of the President of the court last year, Sme prematurely wrote about his termination. However, events of last year showed that public pressure is able to help changes in the judiciary system. This is one of the reasons why it is necessary to keep an eye on judges, writes TIS analyst Samuel Spáč on the organisation’s blog.

Sme cites several cases where former justice minister and former chairman of the Supreme Court and Judicial Council, Harabin, crossed the line of what is perceived as decent behaviour without really breaking the law. So far, he has always managed to evade punishment; and so it becomes all the more interesting how the Judicial Council will react regarding his recent behaviour.
