THE CONSTITUTIONAL Court has thrown out an official complaint made by ethnic-Hungarian student Hedviga Malinová, who protested against an alleged violation of her right to legal remedy and protection from inhumane treatment.
The Court said in a statement published on June 5 that Malinová had failed to exhaust all available legal tools before turning to the Court as a last resort.
Malinová was charged on May 14 with having provided a false statement to police last August when she claimed she had been beaten up by skinheads in a racist attack. Police investigating the case claimed that she made the whole thing up.
The Constitutional Court stated in a ruling dated May 24 that the plaintiff failed to have the decisions of the district prosecutors examined before filing her complaint.
