Čižnár scrapped dismissal of Kočner’s complaint in the murder case

Special Prosecutor’s office will be deciding on Kočner’s complaint again.

General Prosecutor Jaromír Čižnár decided to scrap the decision of a prosecutor from the Special Prosecutor’s Office, who dismissed the complaint of Marian Kočner.

Kočner is charged with ordering the murder of Ján Kuciak, in which the journalist's fiancée’s was also killed.

Čižnár delivered his decision on July 29. Kočner’s attorney Marek Para received the decision 11 days later and the Special Prosecutor’s office on August 7.

On May 2, Para submitted a request for extraordinary remedy against a decision of the Special Prosecutor’s Office.

The latter had denied Kočner’s complaint against the charges in the murder case.

Para was not able to look into the case file, making it impossible for him to give a proper reasoning in a complaint against the charges, he said.

Para nevertheless submitted the complaint against the charges to the Special Prosecutor’s Office, which subsequently dismissed it.

Daniel Lipšic, attorney of the Kuciak’s family, explained that the charges against Kocner in the murder case were not scrapped, the General Prosecutor had now merely fixed a procedural error with his extraordinary remedy.

All the procedures conducted so far regarding the investigation of the murder of Ján Kuciak and Martina Kušnírová remain valid and Kočner is still charged with ordering the murder of the journalist.

Special Prosecutor’s office will decide again on Kočner’s complaint against the charges.
