The interim General Prosecutor, Ladislav Tichý, has filed a motion with Slovakia’s Constitutional Court challenging a public, recorded vote for selection of the next general prosecutor, the SITA newswire reported.
According to his complaint published on the Constitutional Court's webpage he is also asking the court to issue a preliminary injunction to stop a recorded vote in parliament until the Constitutional Court decides on the merits of his challenge.
Tichý’s motion contests several amended parts of the law on parliamentary rules of order that govern the election of the general prosecutor and top representatives of some other bodies and institutions. In expressing his legal opinion to SITA, he said he does not think they are in compliance with the Constitution, which he asking the Constitutional Court to review.
On May 17, the ruling coalition adopted an amendment to the rules of procedure which would make the next election of the general prosecutor a recorded vote. On that same day, the most recent secret vote was held and the only candidate, former General Prosecutor Dobroslav Trnka who was nominated by the opposition, was not re-elected.
