Two judges who were forced to retire contested the decision of two presidents, arguing their right to equal access to elected and other public functions, according to the International Pact on Civic and Political Rights, was violated.
In June 2014, then-president Ivan Gašparovič recalled Marianna Reiffová; and in June 2015, President Andrej Kiska recalled Helena Kožíková. In both cases, the proposal was filed by the Judicial Council, arguing they were already over 65 years of age, the TASR newswire wrote.
The complainants also argued that neither of the presidents had at their disposal a qualified proposal of the Judicial Council for their removal. The proposal had the form of a list of judges aged over 65, which the complainants do not consider sufficient. According to the complaint, the presidents should have asked the Judicial Council for an explanation, which they did not.
However, the Constitutional Court found no reason to question the proposal for removing them, and on December 15 turned down their complaint., as it did other objections and complaints. The case was decided by the panel composed of chairman Lajos Mészáros and judges Ľudmila Gajdošíková and Ladislav Orosz, according to TASR.
