The Bratislava I District Court has rejected a lawsuit filed by Austrian company Kapsch TrafficCon AG concerning the tender for Slovakia's electronic road-toll system won by another firm, SkyToll, in 2008, the TASR newswire reported on Thursday, November 29.
"Almost three years since the suit was filed, the court with its verdict has confirmed that SkyToll didn't engage in any shady business. It met the requirements of the contract [concerning the new electronic road-toll collection system] signed with the National Highway Company [NDS] and it proceeded in line with valid Slovak and [EU] community legislation," said SkyToll PR and communications strategy manager Anton Bodiš.
SkyToll (a joint-stock company established by members of the Ibertax-SanToll consortium) was declared the winner of the tender even though it submitted the most expensive bid (of more than €850 million). The NDS excluded Kapsch along another two applicants, TASR wrote. The tender provoked criticism not only from critics of then transport minister Ľubomír Vážny (a Smer nominee) but also from the European Commission, which alleged that the Transport Ministry had excluded all the candidates - apart from SkyToll - for unjustified reasons.
