PARLIAMENT has passed an amendment to the Criminal Code which will stop courts from returning cases for further investigation due to the lack of evidence.
A change to allow such returns was originally scheduled to be effective as of September, after being passed by the previous government, the TASR newswire reported.
The previous cabinet widened courts’ opportunities to return cases to the prosecution and the police in an amendment which introduced the criminal responsibility of institutions and companies.
Courts previously had the opportunity to return cases to the prosecution for further investigation until 2006, when the Mikuláš Dzurinda-led government cancelled their right to do so.
Presently, courts can return lawsuits mainly for procedural mistakes, TASR wrote. In most cases such mistakes are ruled to have occurred when a defendant receives inadequate representation.
