A multiple killing carried out by an off-duty municipal police officer in Hurbanovo, southern Slovakia, last year cannot be classed as an especially grave crime of premeditated murder, but only as an especially grave crime of murder, the Specialised Criminal Court has concluded. The case against the man, Milan J., will now be heard by the Nitra District Court.
“The overseeing prosecutor of the Special Prosecutor’s Office filed a complaint concerning this ruling, which will be decided by the Slovak Supreme Court,” Andrea Predajňová, spokesperson of the Special Prosecutor’s Office, told the TASR newswire. She pointed out that the investigation of Milan J. was concluded within the legal deadline for pre-trial custody. “As the investigation’s results provided sufficient reason to put Milan J. before the court, the prosecutor of the Special Prosecutor’s Office filed a lawsuit on December 11, 2012 with the Specialised Criminal Court,” she added. The suit was filed for the especially grave crime of premeditated murder – partly attempted and partly committed – along with the crime and transgression of illegal armament and arms trafficking and [trespass]. “The investigation checked all serious factors, including the mental state of the accused during the shooting,” Predajňová told TASR.
The shootings took place on June 16, 2012, shortly after 10:00. Milan J., aged 51, parked his own car in front of the house of a Roma family and then shot dead a 44-year-old man, his 19-year-old son and 24-year-old son-in-law. A second son was shot in the lung and the son’s wife was shot in the leg. The police located the shooter about an hour later, sitting in front of the house of Hurbanovo’s mayor, Margita Zemková, TASR wrote.
