New plans for Special Court

LEGAL experts from the ruling coalition have prepared new plans for the future of the Special Court, which Justice Minister Štefan Harabin, nominated by the ruling Movement for a Democratic Slovakia, originally wanted to shut down for good.

According to the latest proposal from coalition legal experts, the Special Court, which was set up by the previous government to deal with mafia crimes and corruption cases, should be put on the level of regular district courts. Appeals against Special Court rulings would then be handled by the Higher Military Court based in Trenčín, Pravda wrote.

The Justice Ministry confirmed that it was considering the proposed solution.

Ministry spokesman Michal Jurči also admitted that changing the position of the Special Court, which currently stands on the level of regional courts, would only be possible after the elimination of possible constitutional risks. Legal experts are now addressing this problem.

According to the plans, the court’s scope of competence would be expanded to include several other types of organized crime and the special bonuses currently enjoyed by Special Court justices would be decreased.
