The District Prosecutor’s Office in Michalovce confirmed the conclusion of investigator that it is not possible to evaluate the behaviour of headmaster at Košice secondary school when creating new jobs as a one giving reason to launch of prosecution. Thus, it deemed unreasoned the complaint of laid-off teacher Oto Žarnay.
Žarnay taught at the Košice-based Business Academy on Polárna Street and filed a complaint against the way in which the headmaster selected subjects to offer legal services to the school and alleged that some €80,000 were mismanaged. Žarnay himself informed the SITA newswire about the Prosecutor’s Office’s finding on September 23.
The prosecutor concluded that headmaster as the statutory of the school is authorised by law to create new jobs.
Earlier this year, the police dismissed the motion filed by Žarnay, Miroslav Kadúc and Ján Mičovský, MPs for the Ordinary People and Independent Personalities (OĽaNO). The motion pertained to competition over legal services for which the school paid a certain amount every month. The procurer, according to inspectors, did not act transparently and gave the order to a bidder selected in advance.
Žarnay also complained about the alleged violation of duties when administering someone else’s property. He objected to the steps by the school’s headmaster Peter Ivan who created two new working positions: third headmaster’s deputy and school’s matron. According to the main auditor of Košice Region, the school non-transparently spent €66,756 between 2011 and 2013, the TASR newswire reported. The school has denied the results of inspection. During the investigation, the school heard then main auditor Vojtech Farkaš, as well as Ivan. Based on the scrutiny and obtained documents, the investigator claimed that Ivan did not commit a crime. He had the right to create the jobs, which he also included to the organisational schemes of the school and into expenses.
Žarnay said he was disappointed by the decision and told SITA he was considering further legal steps. Aliancia Fair play watchdog and the Via Iuris legal association awarded Oto Žarnay the Biela vrana / White Crow prize for civic bravery.
