Potocký’s complaint alleges misuse of authority by a public official and gross violence against a group of people. "We carefully considered filing the criminal complaint after the Interior Ministry released a statement saying that the police intervention against demonstrators was justified and appropriate, as the protesters were throwing cobblestones [at police officers]," read a statement by Potocký provided to the media. He claims that the incident was provoked by the police, who accompanied the rally during its march towards parliament, where riot police were waiting. "Defenceless and peaceful citizens were then dispersed by [riot police] in a brutal manner," said Potocký.

Along with his complaint Potocký submitted video recordings and pictures from the scene that he claims prove the rally was actually peaceful.
