The senate of the Constitutional Court dismissed a complaint submitted by former prosecutor general Dobroslav Trnka at a closed session held on Thursday, August 23. The judges ruled that the complaint was unfounded and filed by an unauthorised person, the SITA newswire reported.
“I respect the ruling of the Constitutional Court,” Trnka told SITA.
Trnka objected to the vote that took place on May 17, 2011 from which his main rival, Jozef Čentéš, resigned. He claimed that the majority of deputies actually elected him to the post, thus President Ivan Gašparovič should have appointed him.
Since there was another vote held on June 17 at which Čentéš was elected a prosecutor general, Trnka complained about the violation of his basic right to be elected as well as other public functions under the same conditions and rights, without any differences and without unreasonable restrictions to equal access to public service in his country, SITA wrote.
Yet, it is not certain whether Gašparovič will now appoint Čentéš to the post since he is still waiting for another ruling of the Constitutional Court, which was filed by Čentéš, who objected to the inactivity of president on this issue, the Sme daily wrote.
Yet, Čentéš said he is prepared to withdraw his complaint.
“If the president was active and decided over [my appointment], the reason for my complaint would disappear,” he said, as quoted by Sme.
