Constitutional Court chair will not comply with Kiska

A new twist emerges in a complex case surrounding judges selected by parliament but not appointed by President Andrej Kiska.

Chairperson of the Constitutional Court (CC) Ivetta Macejková will not file a move for disciplinary proceeding against the CC 1st panel of judges.

She would have filed the move against 1st panel judges Milan Ľalík, Marianna Mochnáčová and Peter Brňák, as initiated by President Kiska. The Sme daily thus wrote, citing Macejková who also wrote that on November 2 the CC got a motion from Kiska to file a proposal for disciplinary proceeding from October 27 against these three judges. It was connected with the case concerning constitutional complaints of the candidates not appointed for CC.

“With a letter from December 14.... I informed Slovak President Andrej Kiska that I will not file the proposal for disciplinary proceeding against 1st panel judges Milan Ľalík, Marianna Mochnáčová and Peter Brňák,” Macejková wrote. “The reasons are stated in the letter to the president.”

In that letter, Macejková informed that she has studied the president’s arguments, as well as the stances of the CC judges against whom the motion is directed. After having carefully weighed all relevant facts and arguments, she came to the conclusion that the three judges committed no offence, there is no relevant reason to initiate a disciplinary proceeding, and thus, she would not file the proposal for its launch, Sme cites the CC chairperson.
