In 2002 Žitňanská became the state secretary at the Justice Ministry, nominated by the Christian Democratic Movement (KDH). Between February and June 2006 she served as the Justice Minister, after KDH vice-chairman Daniel Lipšic resigned from that post.

In the 2006 election Žitňanská ran as a candidate of the Slovak Democratic and Christian Union (SDKÚ) and was elected an MP. She served as a member and the deputy chair of the parliamentary mandate and immunity committee and as a member of the constitutional affairs committee.

She joined SDKÚ in 2007. In 2010 she was re-elected as MP but chose to relinquish her parliamentary seat to become justice minister.

After she unsuccessfully ran for the chair of SDKÚ chair in 2012, she left the party in December 2013, due to “the recent vagueness of attitudes of the SDKÚ, the loss of content and the inability to make political decisions”.

She joined Most-Híd in April 2014, and one month later she became the party’s deputy chairwoman.
