Regional Court confirmed the rights of Paška brothers were violated

As the right to a defence of the Paška brothers – relatives of the former speaker of parliament for Smer – was allegedly violated, the criminal case goes back to district prosecutor.

The panel of the Regional Court in Košice refused the complaint by the prosecutor against the verdict of Košice I District Court concerning Maroš, Branislav and Martin Paška, nephews of ex-speaker of parliament, Pavol Paška, spokesperson of Košice court Marcela Gálová informed the SITA newswire. Gálová said on January 25 that the appellate panel identified with the findings of the district court and that in this case, the right of the defendants to a defence was violated, as the police officer did not follow the procedure defined in the Criminal order, and failed to warn the accused that their charge was changed to a graver legal qualification of the crime prosecuted.

She added, however, that this decision does not end the criminal prosecution but rather return the case to the prosecutor of the Košice I District Court to remove the serious procedural flaw – the violation of the right to a defence.

The three brothers are accused of several crimes revolving around a conflict from November 22, 2016 in the Main Street, between them and four Košice inhabitants, including one woman who got injured.
