Opposition MPs have filed a complaint with the Constitutional Court against the new act on highways, Lucia Žitňanská (SDKÚ-DS), Daniel Lipšic (Christian Democrats/KDH) and Gábor Gál (ethnic-Hungarian SMK) announced at a press conference on January 10. The Opposition is opposed to allowing the state to build motorways on privately-owned land without the consent of the owners.
According to Lipšic, the Constitutional Court should invalidate the disputed measures, as their application could cause irreversible damage. If the state begins building highways on private property, it would be impossible to restore it to its original condition, he said. Such a precedent would mean that "no man's property is safe," he continued.
"The law doesn’t even provide a time frame by which the state must reimburse the landowner," Gál added.
According to SLOVAKIA, Transport, Post and Telecommunication Ministry spokesman Marián Jánošík agrees the Opposition has the right the bring the law to court, but said: "The act ... is in accordance with the Slovak Constitution."
