Slovak Food Chamber welcomes proposed amendment to Commercial Terms Act

The Slovak Farm and Food Chamber is pushing for greater balance in relations between retail chains and foodstuff suppliers and says a unilateral dictate of commerce against food suppliers which do not appear in business relations in other economic sectors offer sufficient facts to those with an unbiased view of the issue, said the Deputy Chairman of the Slovak Farm and Food Chamber for food sector and sales, Dušan Janíček, as reported by the SITA newswire.

He said that retail merchants have managed to acquire a dominant position in commerce and they use similar practices against food suppliers, who thus have only a narrow scale of partners. Provisions on economic dependence of suppliers on merchants weaken the efficiency of the law on inappropriate commercial terms.

The insufficient definition of "economic dependence" makes a practical provision of its evidence complicated and vague. Janíček told SITA that the Chamber pointed to these difficulties at the time when the law and later its revision were adopted but its efforts were fruitless.

The Chamber therefore welcomes that the latest revision drafted by coalition deputies omits the section pertaining to "economic dependence" and shifts the focus on inappropriate terms. SITA
