Kapsch submitted the objection on August 28, complaining about the tender organiser, the National Highway Company (NDS).

"The objection was aimed against the explanation of the offer submitted to the tender organiser by SanToll consortium and against the evaluation (of the SanToll offer) by NDS," Fialová said.

NDS excluded three out of four bidders participating in the tender (Kapsch, Tossy and Slovakpass), leaving only one contender - the SanToll consortium. Kapsch has complained that NDS violated the principle of non-discrimination against the other contenders by accepting SanToll's controversial responses to its questions about the offer. NDS, by requesting that SanToll explain its offer, allegedly allowed the contender to expand its offer.

"ÚVO has ascertained that the tender organiser acted in line with the law on public procurement, as SanToll's explanation was submitted within the appointed period and its offer met all the requirements set out in the tender," Fialová said. TASR
